Under the ‘Environmental Protection Act’ all businesses and home owners, If you have waste you have a legal ‘Duty of Care’. The Duty of Care applies to everyone involved in handling the waste:
• from the person who produces it
• to the person who finally disposes of or recovers it.
Duty of Care is one of the main ways to combat flytipping. Householders must ensure anyone transporting, storing, treating or disposing of their waste is properly licenced to do so.
Any one failing to do this could face a fine if their waste is fly tipped. The person directly responsible for the fly tipping, the contractor, could also face prosecution.
